Givefinity® Terms of Use

These Terms of Use (“Terms”) govern an individual user’s access to Givefinity. By accessing or using the Givefinity service, you agree to be bound by these Terms, except that an under-13 school-managed user is not required to enter into these Terms as the contractual basis for access. School-authorized under-13 access is governed principally by the applicable school/customer agreement and data-privacy terms, and the child may instead be presented with age-appropriate community or acceptable-use rules. If you do not agree to these Terms where they apply to you, do not use the service. Organization customers are also subject to the applicable Organization Subscription and Platform License Agreement and any data-privacy agreement.
1. Eligibility and account creation
You must provide accurate information and keep your account secure. You are responsible for all activity that occurs under your account, and you must notify Givefinity promptly of any unauthorized use.
Public self-service users must complete Givefinity’s age-screening process. Users under 13 may not create a general public account.
A user under 13 may use Givefinity only through an approved school-authorized or other legally compliant pathway permitted by Givefinity and applicable law. Givefinity does not offer a general direct-parent-consent signup pathway for under-13 users at launch.
If your account is provided or managed through a school or organization, additional privacy and use restrictions may apply.
2. Free volunteer access
Individual volunteer access to Givefinity is free. Givefinity does not require an individual volunteer subscription, free trial, paid “Pro” plan, or individual checkout for core platform access. Organization-level services may be paid, sponsor-funded, complimentary, or otherwise provided without converting a volunteer into an individual subscriber.
3. Your information and service records
You retain your rights in information you submit, including your service activities, reflections, goals, skills, and impact records. You grant Givefinity a non-exclusive, worldwide, royalty-free license to host, process, display, reproduce, transmit, modify solely as technically necessary, and otherwise use your information to provide, secure, maintain, support, and improve the Services, including through service providers acting on Givefinity’s behalf and subject to appropriate contractual restrictions. Givefinity may also create and use aggregated or de-identified data derived from your information for analytics, research, and product-improvement purposes. This license survives termination of your account to the extent necessary for Givefinity to fulfill its retention, audit, and legal obligations.
You control organization connections and sharing to the extent provided by the product and applicable school-management rules.
Ending an organization relationship generally stops future access but may not erase legitimate historical approvals, audit evidence, school records, or organization-generated records that lawfully must be retained.
4. Verification and third-party information
Givefinity may allow supervisors, organizations, or other authorized reviewers to verify service activities. Givefinity does not guarantee that user-submitted or third-party information is accurate. Users may not misrepresent service, hours, approvals, affiliation, or impact.
5. Public profiles and sharing
Where available, public profiles and sharing are optional and subject to privacy controls. Givefinity disables public profiles and public sharing for under-13 and school-managed users. Non-school users ages 13–17 are private by default and may use only specifically designed, age-appropriate sharing features that Givefinity makes available. Givefinity may also restrict public visibility for users whose age has not yet been verified or other accounts requiring enhanced protections.
6. Acceptable use
Do not impersonate others or falsify service records.
Do not harass, exploit, groom, threaten, or endanger another user.
Do not upload malicious code, probe security, scrape the service, or bypass authentication, age gates, privacy settings, usage limits, or organization controls.
Do not use Givefinity data for targeted advertising, sale, unlawful profiling, discrimination, or unrelated commercial use.
Do not infringe intellectual property or privacy rights.
7. AI-assisted features
AI-generated content may be incomplete or inaccurate and should be reviewed by the user. Givefinity may limit or disable certain AI functionality for minors or school-managed accounts. Student Data and school-authorized student content will not be used to train general-purpose AI models, and Givefinity will contractually require applicable AI subprocessors not to use such content for model training. Users should not submit sensitive personal information to optional AI features unless Givefinity expressly indicates that the feature is designed and approved to process that information.
8. Schools and organizations
A school or organization may invite you to connect with it. An invitation does not automatically give the organization access to your complete Givefinity history. Access depends on the type of account, your authorization, applicable school-management rules, and the organization’s approved role.
9. Account suspension and termination
Givefinity may immediately suspend access for security threats, safety concerns, fraud, unlawful activity, material violations, false information, or other material risk to users or the platform. Givefinity may terminate access for material violations or other legitimate operational, legal, or safety reasons. Where practicable, Givefinity will provide notice and an opportunity to resolve the issue. For school-managed accounts, Givefinity will involve the school where practicable and appropriate, subject to security, safety, legal, and student-data requirements. Organization billing problems do not, by themselves, terminate a volunteer’s independently owned account or historical service records.
10. Privacy
Givefinity’s Privacy Policy is incorporated into and forms part of these Terms. The Privacy Policy explains Givefinity’s data practices. School-managed data may also be governed by a Student Data Privacy Addendum or other agreement.
11. Intellectual property
Givefinity owns the platform software, design, trademarks, documentation, and related intellectual property. These Terms do not transfer ownership of Givefinity technology to users.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. GIVEFINITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. GIVEFINITY DOES NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT SERVICE RECORDS, THIRD-PARTY VERIFICATIONS, AI OUTPUTS, OPPORTUNITIES, OR EXTERNAL ORGANIZATION INFORMATION WILL BE COMPLETE, ACCURATE, OR ERROR-FREE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIVEFINITY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE. GIVEFINITY’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS, IF ANY, YOU PAID TO GIVEFINITY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD OR FRAUDULENT MISREPRESENTATION, OR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
14. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles and subject to mandatory rights that cannot lawfully be waived. The parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Wake County, North Carolina for any dispute arising out of or relating to these Terms or the service, except that Givefinity may seek injunctive or equitable relief in any court of competent jurisdiction. Before initiating a formal proceeding, the parties will attempt in good faith to resolve any dispute informally by contacting the other party in writing and allowing thirty (30) days to reach a resolution.
15. Changes and contact
Givefinity may update these Terms at any time. Givefinity will post the updated Terms on the platform and, for material changes, will provide reasonable advance notice where appropriate or required by law, such as through an in-app notice or email. Your continued use of the service after the updated Terms become effective constitutes your acceptance where permitted by law.
